There you have it! A federal judge just ruled that the Pentagon illegally blacklisted Anthropic.
Not a debatable call. Illegal. Unconstitutional. First Amendment retaliation.
Judge Rita Lin, 59 pages: the "supply chain risk" label slapped on Anthropic — a designation normally reserved for companies tied to foreign adversaries, used against an American company for the first time in history — was "arbitrary and capricious," "illegal and baseless."
Her words: the sanctions were "based on a desire to make a public example out of Anthropic for its 'arrogance' in criticizing the government." Not security. Ego.
Look at what Anthropic actually refused. Two things. Letting Claude run mass surveillance on Americans. And letting Claude pick targets in lethal autonomous weapons with no human in the loop. That was the "risk" we torched a $200M contract over.
I have been warning about exactly this for over a year. Emil Michael blew up that contract, kicked the most-deployed frontier model off our classified networks, and handed the whole field to a single vendor. Google. Gemini. Millions of warfighters stuck with a product nobody picked on merit.
Now ask the question nobody at the Pentagon wants asked: who benefits when Anthropic gets blacklisted and Google becomes the only real game on GenAI.mil? And why is the man who made that call so comfortable inside Eric Schmidt's orbit?
That is a conflict of interest that deserves a subpoena, not a promotion.
The President was handed a losing case built on ego by an Uber executive with zero AI expertise.
A court just called that man's signature decision illegal and baseless. He is still setting AI policy for the Department of War while China sprints.
How is that acceptable?
Emil Michael should resign. Today. Before his ego costs us more than a lawsuit.
